
Widening a driveway may look like a simple paving project, but the approval process can involve much more than pouring a wider strip of concrete. The project may change the driveway apron, curb cut, sidewalk crossing, parking layout, stormwater runoff and access through the public right-of-way.

It helps the city or county understand how the work fits on the property and whether it conflicts with property lines, sidewalks, street trees, utility equipment, drainage infrastructure or local parking rules.
Permit requirements vary by jurisdiction. Some local governments require approval whenever a driveway in the public right-of-way is installed, widened, relocated or repaired. Do You Need a Permit to Widen a Driveway?
You may need a driveway, curb-cut, sidewalk or right-of-way permit when the widening affects the portion of the driveway between the street and the private property.
A permit or formal review is especially likely when the project includes:
- Widening the curb opening
- Widening or replacing the driveway apron
- Removing part of a curb
- Reconstructing the sidewalk crossing
- Adding a second driveway entrance
- Relocating the existing driveway
- Creating access to a new garage or carport
- Converting a front yard into additional parking

- Changing drainage inside the right-of-way

Portland states that construction or repair of a driveway within the public right-of-way requires either a Minor Improvement Permit or Public Works Permit, depending on the project scope. The right-of-way section commonly includes the driveway area crossing the sidewalk and connecting to the street. [1]
Seattle requires a curb-cut permit when a new driveway opening is created through an existing curb. The curb-cut approval may be included with a larger construction permit or issued separately. [2]
Minneapolis requires plan review before certain residential curb-cut and driveway-apron work proceeds. A sidewalk inspection permit is also required for construction or repair involving driveway aprons, curbs, gutters and sidewalks. [3][5]
Austin identifies driveway permits as required for new construction, modification, repair or demolition of a curb, gutter or driveway approach inside the right-of-way. [4]
Important: Widening only the private portion of a driveway does not automatically make the work permit-exempt. The wider paved area may still affect zoning, front-yard parking, lot coverage, drainage, trees or required landscaping.
What Part of the Driveway Is Being Widened?
Before preparing the plan, separate the driveway into its main parts.
Private Driveway
The private driveway is generally the paved area located inside the property boundaries. It connects the property line to the garage, carport or parking area.
Driveway Apron or Approach
The driveway apron—also called the driveway approach—is the transition between the private driveway and the roadway.
It may cross:
- The public sidewalk
- A grass verge or planting strip
- The curb and gutter
- An open drainage ditch
- Other land within the public right-of-way
Because the apron is commonly located on public land, cities often control its dimensions, slope, construction material and inspection requirements.
Curb Cut
The curb cut is the lowered or removed section of curb that allows vehicles to enter the driveway.
Widening the private driveway does not necessarily mean the curb cut can also be widened. The curb opening may be limited to protect:
- Pedestrian safety
- Street parking
- Street trees
- Drainage
- Traffic visibility
- Utility equipment
Parking Pad
A parking pad is the widened area used to park a vehicle. It may be connected to the driveway or located beside a garage or carport.
A parking pad may still be regulated even when the curb cut remains unchanged. Local zoning rules may control where vehicles can park and how much of the front or side yard can be paved.

It allows permit reviewers to understand:

- Whether the sidewalk will be affected
- Whether the paving is close to a property line

- Whether utilities or easements cross the project area
Portland’s driveway-permit policy calls for drawings showing proposed and existing driveways, curbs and sidewalks, along with property-line dimensions, street names, on-site structures and a north arrow. [6]
For driveway design exceptions, Portland requires a dimensioned site plan showing property lines, curb lines, sidewalks, the adjacent street, driveway widths, spacing between driveways, lot corners and nearby obstructions such as trees, signs and utility poles. [7]
What Should a Driveway Widening Site Plan Show?
The exact checklist depends on the permitting authority, but a clear residential plan commonly includes the following information.
Property Boundaries and Lot Dimensions
Show the complete legal outline of the property.
Include:
- Front property line
- Side property lines
- Rear property line
- Length of each boundary
- Lot width and depth
- Irregular or angled boundaries
- Property address
The property boundaries provide the reference points for locating the widening and checking whether paving setbacks apply.
Do not automatically assume that a fence, hedge or lawn edge marks the legal boundary. A boundary survey may be needed when the new paving will be close to a neighbouring property.
Street and Right-of-Way
Show the street serving the driveway.
Include where relevant:
- Street name
- Edge of pavement
- Curb and gutter
- Road shoulder
- Public right-of-way
- Road centreline
- Side street on a corner lot
- Public or private alley
The reviewer needs enough street information to understand how vehicles enter and leave the property.
Existing House and Structures
Show the existing house and other structures affecting the driveway layout.

- Fences and gates
The drawing should clearly show which building or parking area the widened driveway will serve.
Existing Driveway
Draw and label the existing driveway before showing the proposed widening.

Show the current width at:
- The curb or road edge
- The front property line
- The narrowest point

Proposed Widening Area

The reviewer should be able to tell what already exists and what will be added without performing a small archaeological excavation through the plan set.

Show written dimensions for both conditions.

- Total proposed driveway width: 18 feet
Measure the width at several points where the driveway changes shape.
The curb-cut width, apron width and private driveway width may be different. Label each one separately.
Driveway Length
Show the approximate length of the widened area.
Dimension the distance from:
- Curb to property line
- Property line to garage
- Street to parking pad
- Beginning to end of the widening
The dimensions help calculate paved area and determine whether impervious-surface or drainage review applies.
Existing and Proposed Curb Cut
Show whether the curb opening will remain unchanged or be widened.
Use labels such as:

Dimension:
- Existing curb-cut width
- Proposed curb-cut width
- Flared or tapered sections
- Distance to side property lines
- Distance to nearby driveways
- Distance to the nearest intersection
Seattle advises applicants creating vehicle access to research driveway width, slope, manoeuvring space, sight triangles and curb-cut requirements. [8]
Driveway Apron
Show the driveway apron between the curb and private property.
Include:
- Apron width at the curb
- Apron width at the property line
- Side flares
- Sidewalk crossing
- Curb and gutter
- Apron material
- Proposed reconstruction limits
Minneapolis asks applicants to show the proposed apron’s size and location in relation to the street, sidewalk, property lines and surrounding public assets. [3]
Sidewalk
Show the public sidewalk where it crosses the driveway.
Include:
- Sidewalk width
- Existing sidewalk alignment
- Area proposed for reconstruction
- Driveway crossing
- Nearby pedestrian curb ramp
- Proposed changes in elevation
The widened driveway should preserve a safe pedestrian route and avoid creating an excessive cross-slope, abrupt step or vehicle overhang across the walkway.
Driveway Setbacks and Property-Line Clearances
Show the distance from the widened paving to:
- Side property line
- House
- Garage or carport
- Fence or gate
- Retaining wall
- Utility equipment
- Other paved areas
Minneapolis currently requires residential curb cuts to remain five feet from property lines unless the adjoining owner provides the required written consent. It also requires clearance from fixed objects in the right-of-way. These are Minneapolis-specific rules and should not be applied automatically elsewhere. [3]
Garage or Carport Connection
Show how the widened driveway connects to the existing garage or carport.
Include:
- Garage-door location
- Garage-door width
- Carport opening
- Driveway centreline where helpful
- Clearance beside walls or posts
- Existing and proposed vehicle paths
The widening should support a practical parking layout. A broad parking pad that narrows to one tiny garage approach can create an elegant concrete funnel with surprisingly little usefulness.

Proposed Parking Spaces
Show where the additional vehicle will park.

- Distance from tree to proposed paving
- Tree-protection area
- Tree proposed for removal
Tree roots can conflict with excavation, apron construction and sidewalk replacement. Tree removal may require separate approval, and the driveway design may need to change to preserve the tree.
Utility Poles, Hydrants and Public Assets
Show public equipment located near the driveway.
This can include:
- Utility poles
- Streetlights
- Fire hydrants
- Traffic signs
- Water meters
- Utility cabinets
- Telecommunications pits
- Mailboxes
- Bus stops
Minneapolis requires residential curb cuts to remain at least five feet from fixed right-of-way structures such as hydrants, utility poles, signs, streetlights and trees. Again, this is a local example rather than a nationwide standard. [3]
Stormwater Inlets and Catch Basins
Show drainage infrastructure close to the curb cut.
Include where applicable:
- Catch basin
- Stormwater inlet
- Curb drain
- Gutter flow line
- Open ditch
- Culvert
- Stormwater pipe
Charlotte’s residential-lot review process checks driveway designs for conflicts with existing catch basins and reviews drainage and flooding issues when applicable. [9]
Surface-Drainage Direction
A wider driveway creates more hard surface and can redirect additional stormwater.
Show drainage-flow arrows indicating where water will travel.
The plan may identify:
- Flow toward the street gutter
- Flow toward an approved drain
- Existing swales
- Low points
- Areas where water may pond
- Direction of runoff from the garage
The proposed paving should not direct water into the garage, toward the house foundation or onto neighbouring property.
Driveway Slope and Profile
A top-down site plan may not be enough when the driveway is steep.
A driveway profile can show:
- Road elevation
- Top of curb
- Gutter elevation
- Sidewalk elevation
- Property-line elevation
- Driveway slopes
- Grade transitions
- Garage-floor elevation
The profile helps reviewers determine whether vehicles may scrape at the curb, sidewalk, driveway crest or garage entrance.
Portland requires a driveway-profile cross section where applicable for a driveway design exception. [7]
Positive Drainage
Driveways should generally be graded so water moves toward an approved drainage route rather than toward buildings.
Portland’s civil design guidance calls for driveways to have positive drainage toward the street and sufficient freeboard. Those detailed engineering standards apply within Portland and should not be treated as universal design specifications. [10]
Depending on the property, the design may need:
- Trench drain
- Channel drain
- Catch basin
- Swale
- Permeable paving
- Connection to an approved stormwater system
Impervious Area
Concrete, asphalt and most conventional pavers are treated as impervious surfaces because they prevent or reduce natural water infiltration.
The site plan may need to show:
- Total lot area
- Existing roof area
- Existing driveway area
- Proposed widening area
- Patios and walkways
- Total proposed impervious area
- Remaining landscaped area
Impervious-area limits and calculation methods vary by jurisdiction. Larger paved areas may trigger stormwater-management requirements.
Driveway Material
Identify the proposed paving material.
Options may include:
- Concrete
- Asphalt
- Interlocking pavers
- Permeable pavers
- Gravel where permitted
- Ribbon driveway
The public driveway apron may need to use a specific material and construction detail even when the private driveway uses another surface.
Easements
Show all known easements affecting the driveway area.
Common examples include:
- Utility easement
- Drainage easement
- Access easement
- Sewer easement
- Stormwater easement
- Shared-driveway easement
Label the width and purpose of each easement.
A driveway may cross an easement in some circumstances, but it must not interfere with legal access, underground infrastructure or maintenance rights.
Shared Driveways
Where the driveway is shared with another property, show:
- Shared driveway limits
- Access-easement boundaries
- Existing and proposed widths
- Property line through the driveway
- Parking and turning areas
- Areas affected by construction
A widening project should not restrict a neighbour’s recorded access rights or redirect drainage toward the adjoining property.
Underground Utilities
Show known services beneath or beside the proposed paving.
These may include:
- Water service
- Sewer lateral
- Gas service
- Electrical service
- Telecommunications line
- Stormwater pipe
Utility access covers, cleanouts and meters should remain accessible after the driveway is widened.
Underground utilities should be located through the appropriate local utility-location service before excavation begins.
Retaining Walls and Grading
Show retaining walls or earthwork needed to support the widening.
Include:
- Existing retaining walls
- Proposed retaining walls
- Wall height
- Cut and fill areas
- Driveway-edge protection
- Drainage behind the wall
- Distance to property lines
A widened driveway may place additional vehicle surcharge on a retaining wall. Structural engineering may be required where the wall supports parking or vehicle access.

Show any gate or fence affected by the widening.

A gate should not swing across a public sidewalk or force vehicles to stop with their rear end projecting into the road.
Corner Lots and Intersections
Corner properties may have stricter driveway-location requirements.

- Both road frontages
- Intersection
- Curb-return radius
- Distance from driveway to corner
- Sight triangle
- Stop signs or signals
- Pedestrian curb ramps
Minneapolis currently requires a residential curb cut to remain at least 20 feet from the end of the street-intersection corner radius. This requirement is specific to Minneapolis. [3]
North Arrow and Drawing Scale
Include a north arrow and prepare the site plan at a consistent scale.
Possible residential scales include:
- 1 inch = 10 feet
- 1 inch = 20 feet
- 1 inch = 40 feet for larger properties
The plan should also include:
- Property address
- Drawing title
- Date prepared
- Revision number
- Drawing scale
Widening the Private Driveway Without Widening the Curb Cut
Some projects widen only the driveway or parking area inside the property while leaving the existing apron and curb opening unchanged.
The site plan should clearly state:
- Existing curb cut to remain
- Existing apron to remain
- Proposed widening begins inside property
- No work proposed in public right-of-way
This approach may reduce the right-of-way work, but it does not guarantee that the private widening is permitted. The zoning authority may still review:

Widening the Driveway Apron and Curb Cut
When the street connection is also widened, the project may require more detailed review.
The plan may need to show:

- Road and gutter elevations
- Drainage direction
- Temporary traffic and pedestrian control
Portland requires a permit for construction or repair of a driveway in the right-of-way. Austin likewise requires driveway approval for modifications to the driveway approach, curb or gutter. [1][4]
Adding a Second Driveway
A second driveway is often reviewed differently from widening an existing driveway.
The authority may consider:
- Whether a second access point is allowed
- Lot frontage
- Distance between driveways
- Street classification
- Available alley access

Does Driveway Widening Require a Survey?
Not every driveway-widening project requires a new survey. An existing survey, house-location plan or recorded plat may provide a suitable base.
A new or updated survey may be needed when:
- The widening is close to a property line
- Property corners cannot be located
- The existing driveway may cross the boundary
- The driveway is shared
- An access easement is uncertain
- The permitting authority requests certified information
A drafted permit site plan is not a legal boundary survey and should not be represented as one.
